OVERVIEW
Welcome to ETA SEOUL.
The terms “we”, “us”, and “our” refer to ETA SEOUL. ETA SEOUL operates this website and online store, including all related information, content, features, tools, products, and services (the “Services”), to provide customers with a curated shopping experience. The Services are powered by Shopify.
These Terms of Service (“Terms”), together with any policies referenced herein (including our Returns & Refunds Policy and Privacy Policy), govern your access to and use of the Services.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your place of residence. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You may not transfer, sell, or assign your account to another party.
You agree to provide accurate, current, and complete information when using the Services and to update such information as necessary.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to display product information accurately. However, product colors, textures, or appearances may vary depending on your device and display settings.
We do not guarantee that product descriptions, images, or other content will be error-free or that products will meet your expectations. All product descriptions and availability are subject to change without notice.
SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. ETA SEOUL reserves the right to accept or decline any order at its discretion. An order is not accepted until payment has been successfully processed.
Once an order is accepted, cancellation or modification may not be possible.
All purchases are subject to our Returns & Refunds Policy, which governs returns, refunds, and exchanges. Such requests are not guaranteed and are handled strictly in accordance with that policy.
Purchases are for personal use only and not for resale or commercial purposes.
SECTION 4 – PRICES AND BILLING
Prices and promotions are subject to change without notice. Prices displayed do not include shipping fees, taxes, customs duties, or import charges unless expressly stated.
You agree to provide valid and accurate payment information and authorize ETA SEOUL to charge your selected payment method for all applicable charges.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates only and not guaranteed. ETA SEOUL is not responsible for delays caused by shipping carriers, customs processing, or events beyond our control.
Once products are handed over to the carrier, risk of loss and title pass to the customer. International shipments may be subject to customs inspections, duties, taxes, or restrictions, which are the sole responsibility of the customer.
SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services, including trademarks, text, images, graphics, and designs, is owned by ETA SEOUL or its licensors and is protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. Unauthorized use is prohibited.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available.” ETA SEOUL has no control over and assumes no responsibility for such tools or your use of them.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to third-party websites. ETA SEOUL is not responsible for the content, accuracy, or practices of third-party sites. Accessing such sites is at your own risk.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
ETA SEOUL is powered by Shopify. All purchases are made directly with ETA SEOUL, not Shopify. Shopify bears no responsibility for transactions between you and ETA SEOUL.
SECTION 10 – PRIVACY
Your use of the Services is subject to our Privacy Policy, which describes how personal information is collected and used.
SECTION 11 – FEEDBACK
Any feedback you submit may be used by ETA SEOUL without restriction or compensation. You represent that you have the right to submit such feedback.
SECTION 12 – ERRORS AND INACCURACIES
We reserve the right to correct errors, inaccuracies, or omissions and to cancel orders if information is inaccurate at any time without prior notice.
SECTION 13 – PROHIBITED USES
You may not use the Services for unlawful purposes, to violate any laws, to infringe intellectual property rights, or to engage in harmful or disruptive conduct.
SECTION 14 – TERMINATION
ETA SEOUL may suspend or terminate access to the Services at any time. Obligations incurred prior to termination will survive termination.
SECTION 15 – DISCLAIMER OF WARRANTIES
The Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, ETA SEOUL shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Services or products purchased through the Services.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless ETA SEOUL from any claims arising out of your use of the Services or violation of these Terms.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
SECTION 19 – ENTIRE AGREEMENT
These Terms, together with the Returns & Refunds Policy and Privacy Policy, constitute the entire agreement between you and ETA SEOUL.
SECTION 20 – ASSIGNMENT
You may not assign these Terms without prior written consent. ETA SEOUL may assign these Terms freely.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of the jurisdiction in which ETA SEOUL is headquartered.
SECTION 22 – CHANGES TO TERMS
ETA SEOUL may update these Terms at any time by posting a revised version on the website. Continued use of the Services constitutes acceptance of the updated Terms.

Section N. Jurisdiction-Specific Consumer Rights
N.0 Common Clause — Defective, Damaged, or Misdescribed Goods

Irrespective of your country of residence, if the product you receive is defective, damaged in transit, or materially different from its description on etaseoul.com, ETA SEOUL will accept the return at no cost to you. In such cases, we bear all return shipping charges, refund the $29 outbound shipping fee, and issue a full refund or free replacement at your choice. This right cannot be waived and applies in addition to any statutory right described in the sections below.

N.1 Australia — Australian Consumer Law (ACL)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in our returns policy limits or excludes these statutory guarantees. The 14-day change-of-mind return window and the non-refundable $29 outbound shipping fee described elsewhere in our policy do **not** apply when an ACL consumer guarantee has been breached.

Pursuant to Article 11 of the Japanese Act on Specified Commercial Transactions (特定商取引法), ETA SEOUL hereby expressly states its return policy ("返品特約") as follows:
- Return window for change of mind: 14 days from delivery
- Return shipping cost: customer bears
- Outbound shipping fee ($29 equivalent): non-refundable
- Items ineligible for change-of-mind return: items marked Final Sale on the product page, underwear/swimwear after seal removal, personalized items
- In the absence of an express return agreement, Article 15-3 of the Act would apply; this clause constitutes such an express agreement and displaces the statutory default.
- Defective or misdescribed goods: see Section N.0 (full refund, we bear return shipping)
- Final confirmation screen compliance (最終確認画面): before order placement, we display all 8 legally required items (seller name/address/phone, price incl. taxes, shipping/other charges, payment timing/method, delivery timing, return/cancellation terms, quantity/spec details, and application validity conditions).

The following provisions apply only to customers residing in Singapore.

Under Part III of the Consumer Protection (Fair Trading) Act 2003 (Singapore) and the Lemon Law provisions of the Sale of Goods Act (Cap. 393), goods must be of satisfactory quality, fit for the purpose made known to us, and match their description. If a defect appears within six (6) months of delivery, it is presumed to have existed at the time of delivery unless we can prove otherwise. In such cases you are entitled to repair, replacement, reduction in price, or rescission (refund). The 14-day change-of-mind window and non-refundable outbound shipping fee do not limit these statutory rights.

Pursuant to Section 16 of the Sale of Goods Ordinance (Cap. 26), goods supplied by ETA SEOUL in the course of a business are of merchantable quality, except in respect of defects specifically drawn to the buyer's attention before the contract is made or, if the buyer examined the goods, defects which that examination ought to have revealed. The Control of Exemption Clauses Ordinance (Cap. 71) applies, and we do not exclude liability for breach of the implied merchantable-quality term against consumers.

N.5 United States — State-by-State Implied Warranty
The following provisions apply only to customers residing in the United States.

Unless expressly disclaimed to the maximum extent permitted by applicable state law, goods sold to U.S. consumers carry the implied warranty of merchantability under UCC §2-314 and, where applicable, the implied warranty of fitness for a particular purpose under UCC §2-315. The following state-specific notices apply:
- **California (Song-Beverly Consumer Warranty Act)**: Implied warranties on consumer goods last for at least 60 days and up to one year. Any disclaimer is ineffective against California consumers.
- **New York (General Business Law §218-a)**: Our refund policy is conspicuously posted on the product detail page and the checkout page. Customers may return eligible goods for refund within 14 days of delivery (see main ToS Return Policy section).
- **Massachusetts, Connecticut, Maine, Maryland, Minnesota, Mississippi, Vermont, West Virginia, D.C., and Kansas**: Implied warranties on consumer goods cannot be disclaimed.
Nothing in these Terms is intended to limit any non-waivable consumer right under the law of your state of residence. The Magnuson-Moss Warranty Act (15 U.S.C. §2301 et seq.) governs where applicable.

N.6 European Union & United Kingdom — Consumer Rights Directive / Consumer Rights Act 2015
The following provisions apply only to customers residing in the European Union, European Economic Area, or the United Kingdom.

Pursuant to Directive 2011/83/EU (as amended by the Omnibus Directive 2019/2161, in force since 28 May 2022) and, for UK customers, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015:
- **Right of withdrawal**: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party other than the carrier indicated by you) acquire physical possession of the goods.
- **How to exercise**: Inform us (support@etaseoul.com) of your decision by an unequivocal statement. You may use the model withdrawal form annexed to the Directive.
- **Effects**: We will reimburse all payments received from you, including the costs of standard outbound delivery, without undue delay and no later than 14 days from the day we are informed of your decision. We may withhold reimbursement until we receive the goods back.
- **Return shipping cost**: You bear the direct cost of returning the goods.
- **Pre-contract disclosure condition**: Our checkout and product pages explicitly disclose, before the order is placed, that the customer bears the direct return shipping cost. If this disclosure is missing in a given transaction, ETA SEOUL will bear that return shipping cost.
- **Pre-Omnibus warning**: We do not use personalised pricing based on automated decision-making for EU consumers.
- **Statutory conformity guarantee (EU) / satisfactory quality (UK)**: Two years from delivery (EU Directive 2019/771); UK CRA 2015 remedies of repair, replacement, price reduction, or rejection apply within the statutory timeframes.

- **옴니버스 고지**: 당사는 EU 소비자에 대하여 자동화된 의사결정에 기반한 개인별 가격책정(personalised pricing)을 사용하지 않습니다.
- **법정 적합성 보증(EU) / 만족스러운 품질(UK)**: 인도 후 2년 (EU 2019/771 지침); UK CRA 2015의 수리·교환·감액·거절 구제책이 법정기간 내 적용됩니다.

N.7 Taiwan — 消費者保護法 第19條
The following provisions apply only to customers residing in Taiwan.

Under Article 19 of the Taiwan Consumer Protection Act, consumers purchasing from a distance seller have the right to return goods or rescind the contract in writing within seven (7) days of receipt, without giving any reason and without any further cost. This 7-day right of rescission applies to Taiwan customers in addition to our general 14-day return window.
